Judge Rules Against Idaho Power
over Snake River Water

TWIN FALLS, Idaho - A lawsuit by Idaho Power Co. against the state in an attempt to obtain more water in the Snake River to generate power at its hydroelectric dams has been rejected by a judge in southern Idaho.

Fifth District Judge John Melanson on Friday said the company legally and knowingly relinquished some of its water rights in the 1984 Swan Falls Agreement.

The company last year challenged the 1984 deal, saying it was being shorted the amount of water it has a legal right to use at the dam south of Kuna in southwest Idaho.

The company says the agreement is flawed because both the state and company underestimated how much water was available.
